This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which require the publication of rules and regulations, privacy policy, and terms of use for access or usage of the Pay Money India website and mobile application.

This web page represents a legal document that serves as our Terms of Use and governs the legal terms of our website, Pay Money India, its sub-domains, and all associated web-based and mobile applications (collectively, the “Platform”), as owned and operated by Pay Money India.

Feel free to browse the website, but please read these terms and conditions before doing so. This website contains many of the valuable trademarks, names, titles, logos, images, designs, copyrights, and other proprietary materials owned and registered by Pay Money India. Please read these Website Terms and Conditions carefully before using Pay Money India / Mobile Application (hereinafter referred to as the "Website"). The Website/Mobile Application is available for your use only on the condition that you agree to the terms and conditions set forth below. If you do not agree to all of the Terms of Use, do not access or use the Website/Mobile Application — and you are required to exit immediately. By accessing or using the Website/Mobile Application, you and any entity you are authorized to represent ("you" or "your") signify your agreement to be bound by these Terms and Conditions. These terms and conditions apply to all users of this Website/Mobile Application (including but not limited to Members and Merchants). Please read these Terms and Conditions carefully, as they affect your legal rights.

USER ELIGIBILITY.

The Website/Mobile Application is operated by Pay Money India and is available only to individuals and entities who are of legal age and capable of entering into legally binding agreements under applicable law. If you do not meet these eligibility requirements, you are not permitted to access or use the Website/Mobile Application.

ACCEPTANCE OF TERMS.

Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website and its Mobile Application. By accessing or using the Website/Mobile Application, you agree to be bound by all the terms, conditions, and disclaimers stated herein. Your access to and use of the Website/Mobile Application and its services is subject (unless expressly stated otherwise) exclusively to these terms and conditions. You agree not to use the Website/Mobile Application for any purpose that is unlawful or prohibited by these terms.

If you are accessing this Website/Mobile Application on behalf of your employer or as an employee, you confirm that you are authorized to enter into legally binding agreements on behalf of your employer and that your employer agrees to be bound by these terms and conditions.

The Website/Mobile Application, including its tools and services, is intended solely for use within the territory of India. Pay Money India makes no representation that its services or tools are appropriate or available for use in locations outside India. Accessing or using the Website/Mobile Application from outside India is considered unauthorized and may be unlawful. Pay Money India reserves the right to restrict access to its Website, tools, or services to any individual, region, or jurisdiction at its sole discretion.

MODIFICATION OF THESE TERMS OF USE

Pay Money India reserves the right to modify, amend, or update any of the terms, conditions, and notices under which the services are offered through its Website/Mobile Application. It is your responsibility to periodically review the Terms of Use, including any changes made from time to time. Continued use of the services following such modifications shall constitute your acceptance of the updated terms, conditions, and notices.

REGISTRATION DATA AND ACCOUNT SECURITY.

Need for registration: To access or use certain features of the Website/Mobile Application, you are required to register with accurate and truthful information including, but not limited to, your full name, business or firm name, full address, mobile number, email ID, PAN number, Aadhaar number, GST number, and other relevant details.

Your Obligations:

  1. By accessing and using the Website/Mobile Application, you represent, warrant, and agree: (a) to provide true, accurate, current, and complete information about yourself as required by any registration forms or templates on the Website/Mobile Application; (b) to ensure that your user account is used exclusively by you and not shared with or accessed by others; (c) not to register or log in on behalf of any other person, or permit others to use your credentials; (d) not to use another user’s account at any time; (e) to safeguard the confidentiality and security of your password, user ID, and any other access credentials; (f) to promptly update your registration and account information to maintain accuracy; (g) that you are fully responsible for all activities under your account, whether or not authorized by you; and (h) not to attempt unauthorized access to restricted areas of the Website/Mobile Application or use any unauthorized methods to do so.
  2. Declaration regarding non-requirement to be registered under the Central / State / UT / Integrated Goods and Services Tax Act, 2017:
    As per the Goods and Services Tax Act, 2017, if you are not required to register under the Act, you declare the following:
    • “I hereby declare that I am not required to register under the Goods and Services Tax Act, 2017 as my turnover is below the taxable threshold prescribed under the Act.”
    • I further confirm that if at any time during the financial year I become liable or choose to register under GST, I will submit all required information and documents to Pay Money India promptly.
    • I understand that providing any false declaration or misleading information shall make me liable for any legal and penal action as per applicable laws, for which I accept full responsibility.
    • Please treat this electronic acceptance as my formal declaration of non-requirement to register under the Goods and Services Tax Act, 2017.

  3. Privacy: Any personal or business information you provide during registration is governed by Pay Money India's Privacy Policy. We reserve the right to disclose such information, in accordance with our Privacy Policy, to: (a) comply with any applicable law, regulation, legal process, or government request; (b) enforce these Terms and Conditions; and (c) protect the rights, safety, and property of Pay Money India, its partners, users, and the general public.

OUR WEB PORTAL – RATES, SERVICES AND TARIFF

In addition to any other applicable terms and conditions mentioned in these Terms of Use and related Service Agreements, the usage of our Web Portal and Mobile Application is governed by the prevailing Rates, applicable Services, and Tariffs of Pay Money India, effective at the time of availing the services. You agree to abide by these charges as they apply to you.

RULES ABOUT USE OF THE SERVICE AND THE WEBSITE / MOBILE APPLICATION:

  1. We will use reasonable efforts to correct any errors or omissions as soon as they are brought to our attention. However, we do not guarantee the Website/Mobile Application or Services will be error-free, and we are not liable for any such issues. Please report any discrepancies to our Customer Care at +91-88661 85661.
  2. While we strive to provide uninterrupted access to our Website/Mobile Application and Services, we do not guarantee constant availability. Access may be suspended, restricted, or discontinued at any time without notice.
  3. We do not warrant that the Website/Mobile Application or Services will be free of viruses or other harmful components. Users are responsible for ensuring their devices are protected.
  4. The Merchant confirms that no officer, employee, or agent of Pay Money India shall be involved in cash handling or settlement activities. The Merchant agrees to fully preload their account using their own funds and shall indemnify and hold Pay Money India harmless from any liability related to unauthorized cash transactions.
  5. We reserve the right to modify, update, suspend, or remove any content or Services on the Website/Mobile Application without prior notice. Temporary access restrictions may occur during maintenance or upgrades, and we will attempt to restore access as quickly as possible.
  6. We reserve the right to block, edit, or remove content that we believe may violate these Terms and Conditions or applicable laws.
  7. The responsibility for collecting and handling third-party data lies solely with the respective channel partner. Subject to this agreement, Pay Money India grants you a limited, non-transferable, non-exclusive, and revocable license to access and use the Website/Mobile Application. Any breach will result in immediate termination of access without notice.
  8. You may not commercially exploit or use any content, data, or functionality from the Website/Mobile Application for another business, unless explicitly authorized by Pay Money India in writing.

USE OF SITE

Subject to the terms and conditions of this Agreement, Pay Money India / Mobile Application hereby grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the Website/Mobile Application for personal and lawful purposes. Any breach of this Agreement will result in the immediate termination of the license granted herein without prior notice. Unless explicitly permitted by Pay Money India in writing, you may not reproduce, distribute, display, sell, lease, transmit, modify, translate, reverse-engineer, disassemble, decompile, or otherwise exploit any portion of this Website/Mobile Application or its content. You may not use the Website/Mobile Application or its content for any commercial purpose or for the benefit of another business unless approved in advance by Pay Money India. Pay Money India reserves the right to refuse service, suspend or terminate user accounts at its sole discretion, especially if user activity is deemed unlawful or harmful to the interests of Pay Money India or its infrastructure.

You shall not upload, distribute, or otherwise publish through this Website/Mobile Application any content, data, or material that:

  1. Violates or infringes upon the intellectual property rights (including copyrights, patents, trademarks, or trade secrets) of any third party;
  2. Is defamatory, obscene, indecent, offensive, libellous, threatening, or otherwise unlawful under Indian law;
  3. Contains or installs viruses, worms, Trojan horses, or other malicious code or harmful elements;
  4. Promotes criminal or tortious conduct, including but not limited to child exploitation, fraud, illegal gambling, drug trafficking, harassment, spamming, stalking, or intellectual property theft;
  5. Utilizes any information from this Website/Mobile Application to harass, abuse, defame, or otherwise harm any individual or entity.

IT ACT, 2000 COMPLIANCE

In accordance with Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011, enacted under the IT Act, 2000 by virtue of clause (zg) of sub-section (2) of section 87 read with sub-section (2) of section 79:

Users of Pay Money India's Website/Mobile Application must not host, display, upload, modify, publish, transmit, update or share any information that —

  1. belongs to another individual or entity without authorization or legal right;
  2. is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, racially or ethnically objectionable, disparaging, promotes money laundering or gambling, or is otherwise unlawful in any manner;
  3. causes harm to minors in any form;
  4. infringes any intellectual property rights, including patent, trademark, copyright, or other proprietary rights;
  5. violates any applicable law in force in India;
  6. intentionally deceives or misleads the recipient about the origin of such messages or conveys content that is grossly offensive or menacing;
  7. impersonates any person or entity unlawfully;
  8. contains viruses, malicious code, or any software/program that could damage or interfere with any computer system;
  9. poses a threat to the unity, integrity, defense, security, or sovereignty of India, disrupts public order, affects relations with foreign states, incites criminal offenses, obstructs investigations, or insults any nation.

TECHNICAL PROCESSING

Due to the global and interconnected nature of the internet, the user understands and agrees that technical processing and transmission may involve (a) sending data across various networks, (b) adapting to technical requirements of different systems, and (c) complying with limitations of services or protocols involved in providing access to the Pay Money India Website/Mobile Application and its services.

DATA PROTECTION

Pay Money India is not liable for any corruption, misguidance, or loss of data submitted by users relating to credit card, debit card, e-wallets, or other payment methods. Personal data submitted through this Website/Mobile Application is governed by our Privacy Policy. Your registration and account information are handled in accordance with that policy.

PRIVACY POLICY

Use of the Website/Mobile Application and its services is governed by the Pay Money India Privacy Policy.

DISCLAIMER

The information, products, and services available on this Website/Mobile Application are provided on an “as-is” basis without any warranties of any kind. Pay Money India disclaims all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. Pay Money India makes no representations about external websites you may access via this Website.

LIMITATION OF LIABILITY

The services and content offered on the Website/Mobile Application are provided “as is” and “as available.” Pay Money India disclaims any and all warranties, including but not limited to accuracy, reliability, merchantability, fitness for a particular purpose, or suitability for any task. All implied warranties or conditions are excluded as permitted under Indian law.

Pay Money India shall not be held responsible for any technical issues related to internet failure, email delivery, servers, software bugs, or system incompatibilities. We also disown liability for any loss of data, unauthorized transactions, deletion of content, or illegal uploads made by users. As an intermediary, we are not responsible for any unlawful activity carried out by users via our platform.

Although Pay Money India makes reasonable efforts to ensure accurate and updated information is available on the Website/Mobile Application, it shall not be held accountable for errors caused by users or technical systems associated with the service.

All conditions, representations, or warranties not explicitly stated in these terms and conditions are excluded to the maximum extent allowed by applicable Indian law.

In no event shall Pay Money India’s total liability exceed the service fees paid by you for the specific service that resulted in the claim.

Pay Money India will not be liable for service disruptions or delays resulting from external causes beyond its control, including but not limited to natural disasters, acts of government, network failures, strikes, civil unrest, or equipment malfunction.

In no scenario shall Pay Money India be responsible for any special, incidental, indirect, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or data loss, even if advised of such possibilities. This includes, but is not limited to:

  • The inability to access or use the Website/Mobile Application;
  • Defects or issues in products, services, or information obtained through third parties via the platform;
  • Claims of violation of third-party rights relating to content or transactions made via the platform;
  • Unauthorized access to or theft of user data by third parties;
  • Statements or actions of any user on the Website/Mobile Application;
  • Issues arising out of Premium or Paid Services, regardless of cause.

WEBSITE/MOBILE APPLICATIONS’ SERVICES.

Upon registering on the Pay Money India Website/Application, the User becomes eligible to access financial services provided by authorized third-party financial institutions, including but not limited to banks, NBFCs, and payment service providers (collectively referred to as “Financial Service Providers”).

The User acknowledges and agrees that Pay Money India is not the provider of these Financial Services. As such, Pay Money India does not guarantee, endorse, or assume responsibility for any products or services offered by these Financial Service Providers or any third-party hyperlinks accessed through the platform.

The User also acknowledges that separate terms and conditions may apply for specific Financial Services. The User must agree to those terms in order to utilize such services or carry out relevant transactions.

CANCELLATION AND REFUND

  1. In the event of a user-initiated cancellation of any bus ticket, Pay Money India shall not be held liable to process or issue any refund.
  2. If an unforeseen event leads to cancellation of a bus or flight ticket by the service provider, only the applicable refund as per the carrier’s policy will be passed on to the user. Pay Money India has no control over airline or bus operators’ policies or decisions.
  3. For transactions resulting in cancellations, Retailers / Master Distributors agree that Pay Money India reserves the right to withhold the cancellation amount from their wallet or any settlement payable. Associated charges, fines, or fees may also be deducted from the same.
  4. Refunds will be credited to the user’s Pay Money India wallet and must be used within one (1) year from the date of refund.

TERMS OF AGREEMENT FOR ONLINE PAYMENTS:

  1. Definitions and Interpretation:

    a). “Facility provider” means the payment gateway or internet banking service provider with whom Pay Money India has a partnership to process digital payments.

    b). “Merchant” refers to the Retailer, Distributor, or other registered business entity using Pay Money India to make payments and access services.

    1.1. Subject to this Agreement, Pay Money India agrees to provide the Merchant with access to digital financial services via its platform.

    1.2. This Agreement remains in effect from the activation date unless terminated as per its terms.

    Pay Money India reserves the right to update terms, fees, and service timelines without prior notice to the Merchant. These changes may apply to any additional or future services offered by Pay Money India.

    By signing this agreement, the Merchant consents to use Pay Money India’s payment gateway for wallet loading and to offer digital services. Accepted payment methods include credit card, debit card, net banking, and UPI. The Merchant assumes responsibility for verifying the identity and details of the cardholder before initiating the transaction. All related disputes must be resolved by the Merchant.

  2. UNDERTAKINGS OF MERCHANT

    In using Pay Money India's payment gateway services, the Merchant agrees to:

    2.1. Not engage in any activity violating law, misusing services, or causing Pay Money India or its partners to face liability or legal action.

    2.2. Use customer/cardholder data only for transaction purposes, and not share it externally unless legally sourced or with customer consent.

    2.3. Always follow laws, rules, and guidelines when using payment services. Misuse or any violation gives Pay Money India the right to revoke services.

    2.4. Handle customer service disputes related to payments independently. Pay Money India will not be responsible for refund or resolution obligations.

    2.5. Cooperate in resolving cardholder inquiries regarding bill payment accuracy or standing instruction execution. All related responsibilities rest with the Merchant.

  3. CHARGEBACKS

    3.1. Pay Money India will notify the Merchant of any Chargeback received from a Cardholder via the Payment Gateway Provider.

    3.2. The Merchant must submit relevant documents (“Chargeback Documents”) within five (5) days of such notice, proving the transaction’s validity or service delivery.

    3.3. If the Merchant fails to respond or submit acceptable documents, the Chargeback amount will be reversed and credited to the Cardholder’s account.

    3.4. Chargeback amounts and related fees may be deducted from the Merchant’s wallet, settlement balance, or held in a reserve for up to 120 days to cover such liabilities. Any unutilized amount will be refunded after this term.

    3.5. If any transaction is disputed due to unauthorized activity, service non-delivery, or fraudulent claims, the Merchant must provide proof of delivery. If unresolved, Pay Money India will refund the disputed amount to the Payment Gateway and ultimately to the Cardholder.

  4. INDEMNIFICATION

    4.1. The Merchant must comply with data and transaction security laws, including the Information Technology Act, 2000, and RBI regulations. If breaches occur due to Merchant negligence, the Merchant agrees to indemnify Pay Money India and the Facility Provider.

    4.2. The Merchant agrees to hold Pay Money India harmless from any losses, penalties, or claims arising from:

    1. (a) Transactions with Payees;
    2. (b) Breach of security involving Payee personal data attributable to the Merchant;
    3. (c) Fines or penalties from regulators for fraudulent or disputed transactions initiated by the Merchant.

    4.3. The Merchant agrees to indemnify Pay Money India for:

    • 4.3.1 Breaches of applicable tax laws, including GST regulations.
    • 4.3.2 Non-compliance with this Agreement, including data accuracy, chargebacks, or penalties.
    • 4.3.3 Claims made by Cardholders or vendors for services rendered.
    • 4.3.4 Acts or omissions of the Merchant’s employees or partners.
    • 4.3.5 Any third-party claim that the Merchant’s service infringes intellectual property rights.

    Pay Money India reserves the right to debit such indemnified amounts from the Merchant’s wallet or future settlements.

    Upon signing the agreement, the Merchant confirms full responsibility for verifying the cardholder’s identity during wallet loading and will resolve all disputes independently.

ENTIRE AGREEMENT

These Terms of Use set forth the entire understanding and agreement between you and Champion Software Technologies Limited with respect to the website/Mobile Application. You acknowledge that any other agreements between you and Champion Software Technologies Limited with respect to the website/Mobile Application are superseded and of no force or effect.
